FAQs from parties to a mediation

What is family law mediation?

Mediation is a form of dispute resolution where an independent person assists conflicting parties to resolve a dispute.

In family law disputes, it involves helping the parties involved to reach a resolution without going to court.

What is the role of a family law mediator?

The mediator in family law matters helps the parties involved in a conflict by providing a process and solutions to enhance their ability to reach a mutually agreeable outcome.

What outcomes can I achieve from working with a family law mediator?

The mediator is there to assist parties to reach an outcome they can agree on, avoiding further disputes and costly litigation.

What skills should you look for when choosing a mediator?

From our experience providing mediation services and engaging other mediators on behalf of our clients, we believe the skills required for successful mediation include:

  • deep experience in the mediation process
  • up-to-date knowledge of current approaches to mediation
  • an ability to deal positively and constructively with people from all walks of life
  • a focus on achieving tangible and mutually agreeable outcomes for the parties involved.
What should I expect in a mediation session?

In a mediation session, think of the mediator like a helpful guide. They'll chat with everyone, ask questions to get to the heart of the matter, and help everyone understand one another better. Finding a solution everyone can live with is the goal, and the mediator is there to help you get there by suggesting ideas without taking sides.

Remember, the mediator won't tell you what to do or give you legal advice, and they'll keep everything you say private. You'll have different types of talks during the session, all aimed at helping you and the other party work things out in a way that's fair for everyone.

Who pays for mediation?

The parties involved typically share the cost of the family law mediation. However, this can be the subject of negotiation between the parties and their lawyers.
